Minutes of Town of Mineral Council Meeting
Public Hearing
7:00 p.m.
October 22, 2007


Roll Call

PRESENT:Mayor Edwin Keller; Vice-Mayor Pam Harlowe, Council Member Roy McGeHee, Roy Payne, William Thomas and Bernice Wilson-Kube.
ABSENT:Council Member Brooks Besley.
STAFF:Treasurer/Clerk Ti-Lea Downing; Town Manager Willie Harper; Town Attorney Jack Maus.

Public Comments
There were no public comments.

Adopt Agenda (add or take away items at this time)
Roy Payne made a motion to accept the agenda as presented. William Thomas seconded the motion. Motion passed 5/0 with None voting in the negative.

New Business:

Meals Tax. The Mayor opened the Public hearing for the meals tax. There were no public comments. The Mayor closed the pubic hearing. Council discussed the meals tax at length. It was decided that catered meals would not be taxed. William Thomas made a motion to accept the ordinance with the effect date of January 1, 2008, with the amendment to 17-12 6 exempting catering. Roy Payne seconded the motion. Motion tied 2/2 with Roy McGeHee and Bernice Wilson-Kube voting in the negative. With Pam Harlowe abstaining due to possible conflict of interest. Mayor Keller voted as the tie breaker and voted for the motion. Motion passed 3-2-1.

Transit Occupancy Tax. The Mayor opened the public hearing for the transit occupancy tax. There were no public comments. The Mayor closed the public hearing. Roy Payne made a motion to table this matter until next months meeting until the lawyer has time to draft a more descriptive ordinance. Bernice Wilson-Kube seconded the motion. Motion passed 5/0 with none voting in the negative.

Streets Ordinance. The Mayor opened the public hearing for the streets ordinance. There were no public comments. The Mayor closed the public hearing. William Thomas made a motion to adopt the street ordinance as presented. Roy McGeHee seconded the motion. Motion passed 5/0 with None voting in the negative.

Enhancement Grant resolution. The Mayor opened the public hearing for the Enhancement Grant Resolution. Joyce Dematteis came before council to speak pertaining to sidewalk extension; she does not want sidewalks in this area. She believes that it would it take away from the rural appeal. The Mayor closed the public hearing. Council Comments Mr. Thomas is opposed to this project due the expense of this project; it is also his concern that the actual construction of the sidewalks would cost $279,350.00 which is a large amount of money. It is would cost the taxpayers a large amount of money. Bernice Wilson-Kube feels that Walton Park should begin generating money before money is spent going to Walton Park. The large amount of money is a major concern. It was decided that at the present time the money is not available for this project. No action was taken on this matter.

Closed Session:
Bernice Wilson-Kube made a motion to go into closed session for the purpose of the acquisition/ disposition of property & personnel pursuant to code 2.2.-37 11 a1 and 2.2-37 11a3. William Thomas seconded the motion. Motion passed 5/0 with None voting in the negative.

Roy Payne made a motion to return to regular session. Bernice Wilson-Kube seconded the motion. Motion passed 5/0 with None voting in the negative.
